Contents

The course deals with issues of public law relevant for ICT. The focus will be on legal relations between individuals and the state authorities. ICT-relevant fundamental rights, the scope of their guarantees and the impact on users and providers of ICT; the functioning of effective remedies when these rights are infringed. Students will acquire knowledge on instruments of the European framework for the regulation of ICT-markets and their national implementation (mainly Telecommunication- , Privacy-  and Media Law). Relevant case law of European and occasionally national courts will be examined. Moreover legal and political questions of internet governance at the international level will be included.

The course is held exclusively online (live streaming). Access is  via the "LEARN"- platform (MS Teams), moreover the link for access is sent out in good time before the start of the first unit.

The students are asked to turn on their cameras during the course - this makes the interactive character of the course more personal for everyone (including the lecturer).

 

Learning outcomes
Students will gain better knowledge about the functioning of governmental and legislative institutions in their significance for the ICT sector as well as actual regulation issues. The critical involvment of fundamental rights and fundamental freedoms in the context of communciation activities will be strengthened.
Attendance requirements

According to the examination regulation full (digital) attendance is intended for a PI. If you exceptionally can´t attend a specific unit please inform via email matthias.traimer@bka.gv.at

Teaching/learning method(s)

The course combines elements of a lecture with active participation from the students. The relevant literature will be provided in class and on the E-Learning Platform (Learn@WU) - beforehand so that you can prepare for the upcoming unit.
Digital attendance (via MS Teams, access at LEARN) is compulsory.

Assessment
The assessment of the course consists of 3 parts:

-    Active participation in the lecture: 20%
-    Short oral/written presentations of a topic: 30%
-    Written exam: 50%
Prerequisites for participation and waiting lists
Students must be able to read legal materials and express themselves in English.
Recommended previous knowledge and skills
Basic knowledge of public and European law aspects at the level of "Europäisches und öffentliches Wirtschaftsrecht I" (of the Studieneingangsphase) is recommended.
